STRICT AND LOOSE CONSTRUCTION

Strict or Loose Constructionism Today our courts are faced with many hard decesions, but the decision that is the hardest is the way that the justices conform to the constitution. There is a spectrum of interpretation. Some justices believe in strict constructionalism, but others believe in loose constructionalism. This is a hard topic of debate. Obviously, things change drastically as time turns over two hundred years. And like the bible, not everything is still relevant. Rules need to adapt this enviroment. Some say we can not have total freedom of speech in such a place where explicit material is so close to minors. It is also important that our country and courts not develop too loose of a view. We need to keep our country heading towards the vision that our founders had. It is important not to lose site of that. They layed the frame, and we have to develop the rest according to the needs of our society. On the flip side, the basic laws of human nature never change. Giving too much power to the future can destroy our rights.

Strict construction is where our fore-fathers wanted the government to go by the constitution more they wanted to have the state government to be the main decision maker in authority. (antifedralists)

Loose construction was just the opposite. They wanted the government to be based more on the elastic clause. They wanted the federal government to be in charge. (federalists)
